Requirements and Easy Steps for Obtaining a Death Certificate in Indonesia

A death certificate is one of the essential documents that heirs must arrange after a person has been declared deceased.

This important document serves as official administrative proof that a person has legally been recognized as having passed away. Obtaining a death certificate is sometimes thought to be complicated, although the process is actually quite straightforward.

A death certificate is one of the important documents that can be compared to other documents relating to an individual's legal relationship with the state.

The difference lies in the function or role of each document. While an ID card (KTP) or Family Card (Kartu Keluarga) shows a person's legal existence in the eyes of the state, a death certificate legally shows and proves that the person named in it has passed away.

For this reason, arranging a death certificate is an important step that heirs must take after a family member has died.

As legal proof of a person's death, the death certificate also serves other administrative functions that are equally important.

One such function of reporting a death, followed by the issuance of a death certificate, is the removal of the deceased's name and national identification number (NIK) from the population register.

Required Documents for Obtaining a Death Certificate

One of the main things heirs must prepare before applying for a death certificate is gathering the documents required for its issuance.

The document requirements for obtaining a death certificate are regulated under Presidential Regulation No. 25 of 2008.

The documents that heirs are required to prepare to apply for a death certificate include the following:

  • Photocopy of the deceased's ID card (KTP).
  • Photocopy of the ID card of the person or party reporting the death.
  • Photocopy of the ID card of the person or party acting as a witness. A witness is a person who knows about the death being reported.
  • Photocopy of the deceased's birth certificate.
  • Photocopy of the marriage certificate, if the deceased was married.
  • Photocopy of the Family Card (Kartu Keluarga) of the deceased and the reporting party.
  • Death certificate issued by a doctor, community health center (puskesmas), or hospital.
  • Death certificate issued by the local subdistrict office (kelurahan) or village office (kantor desa).
  • Death certificate from the local neighborhood head (RT).

These documents must be prepared and then brought to the local Office of Population and Civil Registration (Dinas Kependudukan dan Catatan Sipil) as the requirements for issuing the death certificate.

In some special cases, not all of the required documents can be obtained. For example, in cases where a person has been missing for a long period and is presumed dead, or when the body has never been found. In such cases, the death can be registered once the court has issued a ruling declaring the person deceased.

In other cases, such as deaths where the body is difficult to identify, the death certificate is issued through cooperation between agencies. Registration and issuance of the death certificate can only proceed after a statement has been obtained from the police.

Steps to Obtain a Death Certificate

Once the required documents are complete, the family or heirs of the deceased can submit their application to obtain the death certificate.

The process for obtaining a death certificate begins at the neighborhood (RT) or community (RW) level and continues to the local Office of Population and Civil Registration.

The procedure for obtaining a death certificate from the Office of Population and Civil Registration, the government agency authorized to issue it, can be carried out as follows:

  • The reporting party submits a report to the local RT and RW to obtain a referral letter as proof of death.
  • If the death occurred in a hospital, the reporting party can obtain proof of death in the form of a referral letter from the doctor or hospital.
  • The reporting party brings the death certificate from the RT, RW, or hospital to the local subdistrict or village office to obtain a death certificate from the village or subdistrict.
  • The subdistrict certificate is then taken to the local district office (kecamatan) for certification before being brought to the Office of Population and Civil Registration (Disdukcapil).
  • All required documents and death certificates are submitted to the local Disdukcapil office.
  • The completeness of the documents will be checked by an officer. The reporting party will receive a form to fill in, which must be included in the folder of documents submitted.
  • The folder containing the form, documents, and supporting files for the death report and death certificate application is submitted to Disdukcapil and entered into the population administration census section.
  • The reporting party will be contacted by an officer when the death certificate has been issued, or if there are any deficiencies or errors in the documents required for issuance.
  • If all documents and requirements are complete and the form is filled in correctly, the death certificate will be issued no later than 14 days after the documents are received by the Office of Population and Civil Registration.

Reporting and processing the death certificate should be done by the family or heirs as soon as possible, and no later than 30 days after the date of death.

All death certificate services at the Office of Population and Civil Registration are free of charge, as they are part of the government's public service to its citizens.

The Importance of the Death Certificate

The death certificate is an important document for the family and heirs. This document, issued by the state, is a requirement for a range of legal and administrative needs.

One key function of the death certificate is as part of the documentation needed to distribute an inheritance to the rightful heirs. The transfer of assets as part of the inheritance process to children, a spouse, or other heirs named in the will of the deceased can only proceed once the death certificate is submitted.

In other cases, the death certificate is also required for a widow or widower who wishes to remarry. It serves as proof that the person wishing to marry is no longer bound by a marriage, because the previous marriage ended with the death of the spouse.

The death certificate is also an important document for filing a life insurance claim. Insurance companies will request a death certificate when the heir of the policyholder claims the insured amount under a life insurance policy. Such a life insurance claim may also include funeral insurance benefits, if the policy's coverage list includes such a clause.

Anyone who becomes the heir of an insurance policyholder should understand the procedures and requirements for obtaining a death certificate. This is important because the document must be included in the claim to release the life insurance benefit.

The procedure for obtaining a death certificate is not as complicated as it may seem, is it? If you have experience obtaining a death certificate, you are welcome to share it in the comments.
