Burial Law: Can Two Bodies Be Buried in One Grave?

Funeral arrangements in Islam are about more than carrying the body to its final resting place. There are etiquette and Islamic legal provisions to observe, including the use of the burial plot.

One question that comes up quite often is: what is the ruling on burying over an existing grave? May a newly deceased person be buried on top of an older grave? And may two or more bodies be buried in one grave?

The Ruling on Burying Over Graves in Islam

Every living soul will taste death. After a person passes away, one of the obligations for Muslims is to care for the body and bury it respectfully.

However, limited burial land, especially in big cities, sometimes raises new problems. So what is the actual ruling on burying over graves in Islam?

1. The Basic Ruling on Burying Over or Digging Up a Grave for a New Body

In principle, it is not permitted to dig up a grave that has already been used for a burial in order to place another body in it, as long as the first body has not yet decayed.

This is because digging up or disturbing a grave in such a condition can violate the dignity of the deceased. Classical jurisprudence texts state:

وَإِذَا دُفِنَ مَيِّتٌ لَمْ يَجُزْ حَفْرُ قَبْرِهِ لِدَفْنِ آخَرٍ إِلاَّ أَنْ يَمْضَى عَلَى اْلمَيِّتِ زَمَانٌ يَبْلَى فِى مِثْلِهِ وَيَصِيْرُ رَمِيْمًا فَيَجُوْزُ حَفْرُهُ لِإتِّفَاقٍ

This means that once a body has been buried, its grave may not be dug up to bury another body until enough time has passed for that body to decay, as is customary.

Once the body is confirmed to have decomposed or turned to earth, the grave may be used again. So burying over a grave does not mean it can be done at any time simply because burial land is limited. The condition of the body within the grave remains the main consideration.

2. Why Graves Must Not Be Disturbed Carelessly

This prohibition relates to the dignity of the deceased. In Islam, a person who has died still has a dignity that must be protected. For this reason, digging up a grave before the body has decayed can be regarded as an act that violates that dignity. This is also in line with a hadith of the Prophet:

كَسْرُ عَظْمِ الْمَيِّتِ كَكَسْرِهِ حَيًّا

Meaning: "Breaking the bone of a dead person is like breaking it while he was alive." (Narrated by Abu Dawud, no. 3207; Ibn Majah, no. 1616)

This hadith shows that a body retains its dignity even after death. Therefore, any action taken on a grave must be carried out with great care and must not demean or damage the remains.

3. When Can a Grave Be Used for a New Body?

A grave may be used again once the body previously buried in it has decayed or no longer leaves remains that must be respected. This cannot be determined solely by applying the same timeframe to every place.

This is because the process of decomposition can vary depending on soil conditions, moisture, the depth of the grave, the weather, and other environmental factors. For that reason, it is not right to assume that after one year every grave may automatically be built over.

The book Rahmat al-Ummah states that a grave may be dug again once enough time has passed for the body to be customarily damaged or decayed. The benchmark, therefore, is the condition of the body, not merely the number of years.

4. Determining That the Body Has Decayed Requires Considering the Soil Condition

To determine whether a grave can be reused, the soil and the conditions of the burial ground need to be considered. In jurisprudential discussions, this relates to khibrah, meaning the knowledge or judgment of people who have expertise in soil conditions and the process of decomposition.

Accordingly, a person should not make the decision alone by saying, "This grave is old, so it must be allowed to be built over." If the condition of the remains is not known, the cemetery managers and the family should consult people who understand the condition of the grave and the jurisprudential rules.

The aim is that the process does not end up violating the dignity of the deceased.

5. What If Burial Land Is Limited?

Limited land can indeed be a problem, especially in urban areas. However, limited land does not automatically make it permissible to dig up and build over a grave that still contains remains.

In such situations, reusing a grave must still take into account whether the previous body has already decayed. If it has not, the grave in principle must still be respected and must not be used for another body.

So reasons such as funeral costs, limited land, or the expiry of the grave's period of use do not, by themselves, remove the obligation to protect the dignity of the deceased.

6. Can Two Bodies Be Buried in One Grave?

This question should be distinguished from the case of building over an old grave. Two bodies buried in the same pit from the outset are a separate matter. Under normal circumstances, each body should be buried in its own grave.

However, in emergencies or very pressing needs, several bodies may be buried in one grave. The basis is the hadith about the martyrs of the Battle of Uhud. The Prophet ﷺ said:

Dig deep and wide, make the grave spacious and bury two or three people in the same grave.

Meaning: "Dig, make it wide and deep, and bury two or three people in one grave." (HR. Abu Dawud no. 3215)

This hadith relates to the large number of casualties in the Battle of Uhud. Because there were so many bodies, the Prophet permitted two or three martyrs to be buried in a single grave.

From this hadith it can be understood that burying more than one body in a single grave is not absolutely forbidden in every circumstance. However, there are conditions and reasons that must be taken into consideration.
