Once a person has been declared deceased, heirs or family are required to obtain a certificate of death, commonly called simply a death certificate. This is an important document that must be properly processed and stored so that it is not lost. However, if a family member's death certificate is lost, you can follow the steps for replacing a lost death certificate.
Just as when you apply for a new death certificate, you can apply for a replacement of a lost death certificate at the Directorate General of Population and Civil Registration (Dukcapil). So, how do you replace a lost death certificate? First, let's look at the function of this certificate.
Functions of a Death Certificate
In general, a death certificate can serve as a supporting document or requirement when you handle various matters. Its functions are as follows:
To establish a person's status as a widow or widower, especially for civil servants (PNS). By attaching the death certificate of a deceased spouse, the document becomes one of the requirements for remarrying.
- To process inheritance rights, especially land rights for the surviving spouse or children.
- To process pension claims by heirs, where the death certificate is one of the required supporting documents.
- To process pension benefits, accident, insurance, death benefits, and even banking matters.
- To help the government update the latest population statistics, including monitoring causes of death, calculating life expectancy, and supporting the formulation of regional development policies.
In addition to these four functions, a death certificate is essentially a legal proof that a person has died and that the state has recognized this through the certificate.
This is why a death certificate should be processed promptly, within 30 days of the date of death. This requirement is also set out in Article 44, paragraph 1 of Law No. 24 of 2013, which amends Law No. 23 of 2006 on Population Administration.
Another reason a death certificate should be processed and issued promptly is to prevent the deceased's data from being misused by irresponsible parties.
How to Replace a Lost Death Certificate
So, how do you replace a lost death certificate? In fact, replacing a lost death certificate is much the same as applying for a new death certificate. The only difference is that a few additional requirements must be included.
For a clearer and more complete picture, see the explanation below.
1. Requirements for replacing a lost death certificate:
- A Certificate of Loss from the local police, stating that the previous death certificate was lost.
- A Death Certificate from a doctor, hospital, or authorized party.
- A Death Certificate from the village or sub-district (desa/kelurahan).
- The original e-KTP (electronic national ID card) of the deceased.
- A photocopy of the e-KTP of the person reporting and applying for the replacement.
- A photocopy of the marriage certificate or marriage record for a reporting party who is married.
- An extract of the birth certificate of the deceased.
- Photocopies of the e-KTP of 2 (two) witnesses.
- Immigration documents for foreign nationals (WNA) who were permanent residents.
2. If a person is missing, or a body is found and/or the identity is unclear, the additional requirements are:
- A certificate from the police.
- A copy of the court ruling concerning the death of the missing person, or of a person whose whereabouts or remains are unknown.
- The applicant must complete and sign an Absolute Statement of Responsibility as a commitment to ensure the information provided is true and that the applicant takes full responsibility.
3. Procedure for replacing a lost death certificate:
- Make sure you have met all the requirements set for replacing a lost death certificate. Visit the local or nearest Disdukcapil office with all the documents described above. Clearly explain your purpose to the officer, and be sure to follow the established rules and procedures.
- Proceed to the counter for replacing a lost death certificate as directed by the officer.
- Submit all required documents to the officer at the counter. The officer will check that your documents are complete and verify the data.
- If the requirements are complete and pass verification, Disdukcapil will promptly process the new death certificate. If your documents are incomplete, you will be asked to complete them and return to the Disdukcapil office.
- For complete and accepted requirements, the officer will tell you when you can return to collect the death certificate. Usually, the death certificate will be ready within 14 days at the latest.
As additional information, please note that the people entitled to apply for a new or replacement death certificate are the closest relatives, meaning those who live in the same house or on the same Family Card (Kartu Keluarga, KK). For this reason, you should also bring a photocopy of the KK as proof, in case the Dukcapil officer asks about your relationship to the deceased.
Applying for a Death Certificate for a Long-Past Death
Sometimes, a death cannot be reported right away for one reason or another. In other words, the family may not be able to report a death within 30 days of the date of death, as required under Law No. 24 of 2013.
If you face a similar situation, you still need to obtain a death certificate. As explained earlier, a death certificate serves several important functions, one of which is to prevent the deceased's data from being misused by irresponsible parties.
So how do you apply for a death certificate for someone who died long ago? Basically, the requirements are similar to those for a new death certificate or a replacement for a lost one.
Once you have gathered and confirmed that all documents are complete and accurate, visit the nearest Dukcapil office. Tell the officer that you wish to apply for a death certificate for a family member who died some time ago, and explain why the application is late. Speak clearly and politely, then follow the officer's instructions to make the process easier and faster.
That is the summary of how to replace a lost death certificate, including the documents you need and the steps to follow. We hope this information is helpful, especially if you currently need it.
